News today that the Union's application for leave to appeal to the Supreme Court of Canada on its challenge of Suncor's random drug testing policy was dismissed. Long story short this means that the decision of the Alberta Court of Queens Bench and Court of Appeal will stand and force the matter to return to a new arbitration panel, with direction to the new arbitration panel that Suncor's evidence of drug and alcohol incidents in the workplace may include incidents at the shared workplace outside the Union's bargaining unit. The initial arbitrator had refused to consider evidence that included incidents in the shared workplace but outside the Union bargaining unit.
